When should a title company order the HOA estoppel?

Order the HOA estoppel the day the executed contract and signed owner authorization naming the agency are on the file. Do not wait for the title commitment, inspections, or clear-to-close. Do not order so early that the letter’s effective period expires before funding.

This is for the closer or processor at a 5-to-30-person title agency or attorney-closing firm on Qualia, SoftPro, ResWare or RamQuest who has to pick the day the request goes out.

What you are ordering

An HOA estoppel letter, also called an estoppel certificate, resale certificate, or “HOA docs,” is the association’s written statement of what the owner owes and what else attaches to the unit or parcel as of a stated date. The closer funds against it. A seller’s verbal or last year’s packet is not that letter.

How long it takes to get an HOA estoppel letter is the clock. This page is the day you send the request so the letter is still good on the funding date. A payoff statement is a different artifact. How long a mortgage servicer has to send a payoff statement is that page. Order both the day the file is opened.

The window, not a single day

There is no federal when-to-order rule. The right day sits between two failures: a letter that dies before funding, and a request that starts too late for the association’s clock.

On a refinance, the same window applies against the funding date, once borrower authorization is on the file. Board approval and a right of first refusal, when they exist, show up on the letter. Ordering at contract is how those have time to run.

What has to be on the file first

A request that is missing the authorization often has not started. Log the packet in Qualia, SoftPro, ResWare or RamQuest.

If the listing or contract already names the association, do not wait for the title commitment to repeat it. If you only learn the HOA from the search, order the day the commitment names it.

What not to wait for

Clear-to-close is a lender flag. It is not an HOA clock. Inspectors and appraisers do not issue estoppels. A management portal that says “allow 15 business days” is that shop’s queue, not a statute. Shops still quote a 15-day Florida clock. The 2026 Florida statutes are ten business days after the association receives a written or electronic request. Receipt, not send.

Self-managed associations, a board that meets monthly, and a portal with a payment queue run the full clock even when the statute is on your side. Send the request the day the packet is complete, not ten business days before funding.

On a Florida file, ten business days is two calendar weeks plus any weekend or holiday inside the window. Count backward from the contract date before you decide the request can wait.

When closing moves

If funding slips past the letter’s effective period, request an amended or updated certificate the day you know. Do not guess amounts off a stale letter. Florida starts a new 30-day or 35-day window on the amended certificate and does not charge for it. Texas’s update is due in seven business days and has to be made within 180 days of the original. If the contract is shorter than the association’s clock, request the expedite with the first order.

More than one association

Order every association the same day. Each has its own clock and its own fee. Florida’s statutory form requires the issuing association to list every other association the parcel belongs to. If you already know there is a master, send that request with the first. A HELOC payoff is still a servicer letter. Do not treat the HOA estoppel as the loan payoff.

If the letter is still out

Keep chasing. Daily portal and the management number already on the file, not a number that arrived with a rush email. On day ten in Florida, treat it as late. A late association forfeits the fee and still has to issue the certificate. That does not replace the chase, and it is not a reason to fund without the letter.

Take this afternoon’s open files. For every HOA or condo closing in the next 30 days, check whether the estoppel request went out the day the contract and authorization landed, whether every association on the parcel has its own request, and whether the letter in the file still covers the funding date. Send anything missing today.

Frequently asked questions

Can we wait until the title commitment shows the HOA before we order the estoppel?

If the listing or contract already names the association, no. Order that day. If you only learn the HOA from the search, order the day the commitment names it. Waiting another week after that is how a 30-day contract eats the whole statutory clock.

What if the contract is only 21 days and the association has ten business days?

Order the same day, and request the expedite the statute allows. Florida's three-business-day rush is the extra fee. North Carolina adds an expedite fee if the request lands within 48 hours of closing. A 21-day cash close does not get a week of waiting.

Does a Florida estoppel expire if closing slips past the letter's date?

Yes. Thirty days if handed over or emailed, thirty-five if mailed. Request an amended certificate. Florida does not let the association charge for the amendment. A stale certificate is not one a closer can fund from.

Should we order the estoppel before the seller has signed authorization?

No. Florida treats the title company as a designee. Texas starts the clock only after the association receives and verifies the requester's authority. A portal order without owner authorization has often not started.
