How to get a property tax certificate for a real estate closing, for title agencies?
By the Saltheron team · Last updated
Send a complete written request, with the parcel or account number and the collector’s fee, to every tax collector on the parcel the day the contract is on the file. Fund from the signed certificate those collectors issue. A seller’s last bill, a website printout, and a verbal from the 1-800 are not the certificate.
This is for the closer or processor at a 5-to-30-person title agency or attorney-closing firm on Qualia, SoftPro, ResWare or RamQuest waiting on the tax cert.
What the tax certificate is
A property tax certificate, also called a tax cert, tax search, or certificate of taxes due, is the collector’s signed written statement of taxes, penalties, interest, and known costs due on the parcel according to current tax records. The closer prorates from it, pays delinquencies from it, and raises Schedule B exceptions from it. It is not a seller’s last bill and it is not a mortgage payoff.
What a complete certificate usually carries:
| Item | Why the closer needs it |
|---|---|
| Parcel or account number, owner of record | Wrong account, or a “we cannot locate” reply |
| Tax year and amounts due or paid | The proration base |
| Delinquencies, penalties, and interest | What has to be paid at closing |
| Each taxing unit that collector covers | County, city, school, MUD, or special district |
| Outstanding tax sales | A first lien the policy will not ignore |
| Next due date, or levy not yet calculated | A stale figure on a short close |
There is no federal clock. The wait is whatever that collector takes after a complete, paid request. Log the packet on the file in Qualia, SoftPro, ResWare or RamQuest.
Two documents share the same name
In Florida, “tax certificate” is a defined term for a different artifact. Fla. Stat. § 197.102(1)(f) (2026 Florida Statutes, read 2026-10-15) is a first lien for unpaid delinquent real-property taxes, non-ad valorem assessments, interest, and related charges. § 197.432 (read 2026-10-15) is the collector’s sale of those certificates.
On a Florida file, order the collector’s current-tax statement the closer prorates from, and a separate search of outstanding tax-sale certificates. Recorded land records do not always catch certificates that live in the collector’s sale list.
What to put in the request
A complete request, sent the day the contract is on the file:
| Item | Why it is on the request |
|---|---|
| Parcel ID or collector account number | Address-only requests bounce when the roll uses a different street |
| Property address and legal description | Same |
| Owner name as it appears on the tax roll | A prior owner is a usual “cannot locate” |
| Closing or funding date | The certificate needs a window that covers the contract |
| Agency name, file number, and where to send it | So the PDF lands on the right closer |
| Fee paid with the request | Harris County and El Paso County, Colorado, both refuse unpaid requests |
| Every collector on the parcel | Separate city, MUD, or school collectors are separate certificates |
| Every account on the parcel | Harris County’s form, rev. 08/2025, read 2026-10-15, lists each account at $10 |
Harris County’s tax-certificate request form (rev. 08/2025 v4, read 2026-10-15) is a live packet of those fields. The fee is $10 per certificate. Processing is 2 to 3 business days after they receive the request and the payment. Mail, fax 713-368-2129, or email TaxCert@tax.hctx.net.
SoftPro 360, rechecked 2026-10-15, is one channel for ordering tax certs from inside SoftPro. You still pay the vendor or the collector. 360 is not the certificate.
What to leave off
| Move | Why it fails |
|---|---|
| Phone-only request | The statutes we read issue a writing. A verbal is a file note |
| Seller’s last tax bill as the cert | Last year’s bill is not this collector’s current records |
| County-website printout treated as the certificate | Colorado’s public site is not the signed treasurer certificate |
| One collector when a MUD or city collects on its own | That unit’s lien is still open |
| Unpaid request | The collector has not started |
| Funding from a seller promise that the account is current | The certificate is what the closer funds against |
| A vendor report in Colorado the treasurer did not issue | C.R.S. § 39-10-115(4), read 2026-10-15: only the treasurer or an authorized agent issues it |
On new construction, shops also order an after-improved estimate. That estimate is not a substitute for the signed certificate on the accounts that exist today.
Where to send it
| Channel | Use it | Skip it |
|---|---|---|
| Collector portal or title-company CTD portal already on the file | Yes | A new login that arrived with a rush email |
| Collector’s published request form, with the fee | Yes | A generic letter with no account number and no check |
| Mail, fax, or email the collector published for tax certs | Yes | Customer-service 1-800 as the only send |
| Production-system vendor portal (SoftPro 360 or the Qualia, ResWare, or RamQuest equivalent) | Yes, then confirm the collector actually issued it | Treating the vendor’s cover sheet as the statutory certificate |
El Paso County, Colorado (read 2026-10-15) runs a CTD portal for title companies. Mail-in requests need a $10 check; unpaid requests are not processed. Allow 48 hours after the office receives the request. The county’s FAQ repeats C.R.S. § 39-10-115(2)–(3) (read 2026-10-15): the signed certificate is conclusive evidence, and the county pays a loss from an error.
The chase
Do not wait for the title commitment, clear-to-close, or the seller to drop off a bill. Those flags do not start a collector’s work.
| When | What to do | Through which channel |
|---|---|---|
| Day the contract lands | Send a complete written request. Pay the fee. Order every collector and every account | Designated portal, form, fax, or mail already on the file |
| Same day | Confirm the portal or mail shows received and paid. Log the received date | Portal receipt, then the collector number already on the file |
| Business day three | If nothing is back, confirm the ticket and the delivery method | Portal message and the number already on the file |
| Every business day after that | Resend the complete packet. Ask for the tax-certificate desk, not the general voicemail | Portal, published email, and the phone. Do not pick one |
| After a new levy, a tax-sale date, or a slipped closing | Refresh the certificate so the window still covers funding | Same channels |
Call the number already on the file or the collector’s published tax-certificate line. Never a number that arrived with a rush email. Note the time, the name on the other end, and the ticket number. This is a different third party from the HOA estoppel. Do not treat the tax cert as the loan payoff. A complete payoff request is a separate packet.
State rules we read
The rows below are only the statutes read for this page. Other states differ. Check the underwriter’s bulletin and counsel. This is not legal advice.
| Place | What the collector must issue | Fee we read | What else |
|---|---|---|---|
| Texas | Certificate of delinquent taxes, penalties, interest, and known costs, listing each unit that collector covers | Not more than $10, Tax Code § 31.08, read 2026-10-15 | Any person may request it. A transfer with a certificate that erroneously shows no delinquencies extinguishes that unit’s tax lien, with exceptions for fraud and certain canceled homestead exemptions. Harris County takes 2 to 3 business days after receipt and payment |
| Colorado | Certificate of taxes due, outstanding tax sales, redemption amounts, and mill levies by jurisdiction | $10, C.R.S. § 30-1-102(1)(f), read 2026-10-15 | Signed and showing taxes paid, it is conclusive evidence. The county pays a loss from an error. Only the treasurer or an authorized agent issues it. El Paso County allows 48 hours after receipt |
| Florida | Current taxes from the collector, plus a search of outstanding tax-sale certificates | Collector’s own search or copy fee. No statewide cap like Texas or Colorado in the statutes we read | “Tax certificate” in § 197.102(1)(f) is the lien sold under § 197.432, both read 2026-10-15 |
On a Texas file, closing without the certificate is how a missed delinquency stays attached to the buyer. On a Colorado file, a vendor PDF the treasurer did not issue is not the certificate. On a Florida file, skip the tax-sale search and an outstanding certificate can still sit through funding.
When the certificate comes back
Prorate from the certificate, not from the seller’s memory. Pay delinquencies to the collector from seller proceeds, or from funds the contract named, before recording. If the current year is not yet levied, the certificate should say so. Do not plug a guessed millage on the settlement statement.
The pay-to is untrusted until a named person at the agency confirms it at a number or portal already on the file, never a new account from an email that arrived with the certificate. How a title company should verify payoff wire instructions is that callback on a payoff letter. Use the same rule when the disbursement is a tax collector.
If the certificate will miss the contract date, flag the closer that day. Resend the complete packet. Do not fund on a verbal.
Pull the files closing in the next 30 days. Confirm each has a signed tax certificate from every collector on the parcel, a paid request log, and a window that still covers funding. Resend any packet that is missing an account, a fee, or a collector, and log the sent date on the file that afternoon.
Frequently asked questions
Is a printout from the county tax website the same as a tax certificate?
No. In Colorado the signed treasurer certificate is conclusive evidence, and only the treasurer or an authorized agent may issue it. El Paso County's tax-certificate page, read 2026-10-15, says the public website shows the current billing cycle and does not always reflect prior-year or future balances. Order the certificate. A printout is a file note.
Do we need a tax certificate from every taxing unit on the parcel?
Yes, when those units use different collectors. Texas Tax Code § 31.08, read 2026-10-15, says a collector who collects for more than one unit must show each unit on that one certificate. A city, MUD, or school that collects on its own is a second request and a second fee. One county certificate does not cover a separate collector.
In Florida, is the tax certificate the document we fund against at closing?
No. Florida's statute defines a tax certificate as the first lien sold for unpaid taxes. That is a different artifact from the collector's current-tax statement a closer prorates from. Order both current taxes and a search of outstanding tax-sale certificates. Do not treat a Florida tax-sale certificate as the closing tax cert.
Can the closer fund on a verbal figure from the tax collector?
No. The signed certificate is what Texas uses to extinguish a missed tax lien on transfer, and what Colorado treats as conclusive evidence. A verbal from the 1-800 is a file note. Pay delinquencies to the collector at the pay-to already on the file, never a new account from an email that arrived with the numbers.
