What to do when the HOA management company won't respond to an estoppel request, for title agencies?

By the Saltheron team · Last updated

Confirm the written request actually started, then chase the portal and the management number already on the file every business day. Flag the closer if the letter will miss the contract date. Do not fund from a seller promise. A late fee forfeiture and a court order still leave you waiting on the certificate.

This is for the closer or processor at a 5-to-30-person title agency or attorney-closing firm on Qualia, SoftPro, ResWare or RamQuest who has an HOA or condo estoppel outstanding and a manager who has gone silent.

How long it takes to get an HOA estoppel letter is the clock. When a title company should order the HOA estoppel is the day the request goes out. How to get an HOA estoppel faster is the day-one chase. This page is the file after that clock has run and the portal is still quiet.

Why the manager is still silent

An HOA estoppel letter, also called an estoppel certificate, resale certificate, or “HOA docs,” is the association’s written statement of what the owner owes and what else attaches to the unit or parcel as of a stated date. The closer funds against it. Silence is usually a request that never started, the wrong manager, or a ticket sitting in a portal.

What you see Usual cause First move
Portal ticket unpaid or “pending payment” Texas may require payment before work begins. Most portals wait for the invoice Pay it from the agency account that day
Silence after a phone request The clock runs from a written request the association received Resend to the designated website address or portal
New manager, old portal, or not on HomeWiseDocs or CondoCerts Management just transferred. Records often lag Confirm the current agent. Order through the new channel
“Authorization required” Owner authorization missing or named the wrong agency Resend it with the request. The clock has not started
Account in collections Florida’s form names the collection attorney. That desk now has the file Send the complete packet to that attorney the same day
Self-managed, no board, or a board that meets monthly There is no transfer desk Written request to the registered agent. Seller and listing agent in the chase
Portal shows received, nothing arrives Ticket is sitting, or delivery went to an old fax Confirm the ticket, the delivery method, and who owns it

Log the cause in Qualia, SoftPro, ResWare or RamQuest so the next person does not restart from a cold 1-800.

Confirm the request actually started

Receipt of a complete written request starts the clock. Florida’s three statutes all start “after receiving” a written or electronic request. Texas Property Code § 207.003 (read 2026-10-13) starts after the written request and evidence of authority are received and verified. California Civil Code § 4530 (read 2026-10-13) starts within 10 days of mailing or delivery. An unpaid portal invoice has often not started work even when a statute’s clock has.

A complete request, logged on the file, contains written owner authorization naming this agency, the property address and unit, the owner name on the association’s books, the closing or funding date, where to send it, the fee paid or invoiced, and a separate order for every association on the parcel. If any of those is missing, fix it and resend the same day.

Have the seller pull a ledger from their own portal if they have a login. Treat that screenshot as untrusted. It is not the certificate.

Chase it every business day

Follow up before the statutory cap expires.

When What to do Through which channel
Same day the request looks late Confirm receipt, payment, authorization, expected delivery, and whether a collection attorney has the account Portal message, then the management number already on the file
Every business day after that Resend the complete packet. Ask for the transfer desk Portal, designated email, and the phone. Use all three
New manager, or a portal that cannot find the association Confirm the current agent on the last known letter and the state’s business-entity search New portal if there is one, plus the registered agent
Second association still dark Separate request, same chase That association’s designated address or portal

Call the number already on the file, the listing package, or the last known-good letter. Skip a number that arrived with a rush email. Note the time, the name on the other end, and the ticket number. Put the listing agent on the same log. A manager who will not take a title-company call will sometimes return the listing side.

If the letter that finally arrives includes wiring instructions for assessments, treat those numbers as untrusted until a named person at the agency has called back at a number already on the file.

What the statute does once the clock has run

The rows below are only the statutes read for this page. Other states differ. Check the underwriter’s bulletin and counsel. Not legal advice. Florida has no $0 certificate after a second request. That path is Texas.

Place If they miss the clock What the closer still needs
Florida HOA, condo, cooperative No fee may be charged. The association still has to issue it. A summary proceeding under s. 51.011 (read 2026-10-13) can compel compliance, with a five-day answer and prevailing-party attorney fees. § 720.30851(4)–(5), § 718.116(8)(d)–(e), § 719.108(6)(d)–(e), 2026 Florida Statutes, read 2026-10-13 The written certificate. The five-day answer is slower than Friday’s contract
Texas property owners’ association No fee if the certificate is late (§ 207.003(c-1), read 2026-10-13). The title company, as the owner’s agent, may send a second request. If nothing is back by the fifth business day after that second request is mailed certified, return receipt requested, or hand delivered with a receipt, § 207.004 (read 2026-10-13) lets the owner give the buyer an affidavit that the two written requests were made and ignored. That affidavit, if given, ends the association’s lien for amounts then due The underwriter’s sign-off on the owner’s affidavit. The agency does not write it
Arizona planned community Ten days after receipt. Binding if requested by a licensed escrow agent. Failure to provide the statement to that escrow agent extinguishes the lien for any unpaid assessment then due (A.R.S. § 33-1807(J), read 2026-10-13) The statement itself. Transfer fees, violations, and board approval still sit on it
California CID Ten days of mailing or delivery. Delivery may not be withheld except for the fee (Civil Code § 4530, read 2026-10-13) Payment of the § 4528 estimate if that is why they have not started
North Carolina planned community and condo Unpaid-assessment statement within 10 business days (G.S. 47F-3-102(13a) and G.S. 47C-3-102(12a), read 2026-10-13) A request sent well before 48 hours of closing. That extra fee is a late-request surcharge

What you still cannot do

Move Why it fails
Fund from a seller promise, or plug guessed dues on the settlement statement The letter is what the closer funds against
Treat an owner-portal screenshot as the certificate It is a ledger, not the association’s signed statement
Order the sub and wait for it to name the master Two associations are two clocks. Order both the same day
Wait out a Florida summary proceeding to fund this week A five-day answer is slower than the contract date
Treat a stale certificate as current Florida’s letter is good 30 days if handed or emailed, 35 if mailed. Request an amended certificate. Florida does not charge for the amendment

When to postpone

If the letter will miss the contract date, flag the closer the same day. Tell the listing side and the incoming lender what is missing: a written estoppel from the current association. Hold a second association that is still dark unless the closer has a written plan for that association. Refresh the certificate when closing moves.

Take this afternoon’s open files. For every HOA or condo closing in the next 30 days that still has no letter, confirm the current manager, the designated address or portal, the paid invoice, the signed owner authorization, and whether a second written request has gone out where the statute gives you one. Log each chase on the file that afternoon.

Frequently asked questions

Does a phone call to the management company start the statutory estoppel clock?

No. Florida, Texas, California, North Carolina, and Arizona clocks on this page run from a written request the association actually receives. A call is a file note. Send the complete packet to the designated address or portal, with owner authorization attached, and log the received date.

Can we close if the manager is silent and the seller says the account is current?

No. The letter is what the closer funds against. A seller's verbal, a screenshot from the owner portal, or last year's packet is not the certificate. Flag the closer the day the clock runs, and keep the portal and the management number already on the file in play every business day.

What if the association just changed management companies and the new shop has no records?

The association still owes the certificate. Confirm the current manager on the last known letter and the state's business-entity search. Order through the new portal if there is one. Do not wait for a records transfer. If the account is in collections, send the request to that attorney the Florida form names.

Does Florida's late-fee forfeiture mean we can fund without the estoppel certificate?

No. A late association forfeits the preparation fee and still has to issue the certificate. A summary proceeding under s. 51.011 can compel it. Neither is a reason to fund from a seller promise. The closer still needs the written letter.
